Prerequisites
Enrollment into the 3rd year of study.
Content (Syllabus outline)
– Public Procurement Act objectives in connection with the provisions of the Law on Amendments and Supplements of the Public Procurement Act (PPA-2C).
– Importance of the notification obligation of the client.
– Implementation of commercial public services.
– Outline of foundations for the decision of the client in the procurement process to eliminate a candidate or a tenderer.
Possible versions of the public service implementation:
– directly under the municipal administration,
– through the establishment of public institutions and public companies,
– on the basis of a granted concession,
– by investing capital in the activity of private persons.
– Protection of public goods users.
– Concession of public service.
– Concession of commercial public service.
– Concessions for the use and exploitation of natural resources.
– Concessions in other areas, e.g. gambling.
– Concession of relationship.
– Importance of the decision regarding the selection of the concessionaire by the grantor.
– Capital Assets Management in Slovenia in terms of the Management of Assets Owned by the Republic of Slovenia Act.
Study Literature
The study literature will be published online before the lecture start.
Objectives and competences
General competencies:
Understanding the evolutionary nature of the law of public utilities and the meaning of concessions.
Ability to form the basis for any reflections on the introduction of concessions.
Subject-specific competencies:
Understanding of professional and correct response regarding the choice of different versions of the public service and content appropriate formation of the relationship between the grantor and the grantee.
Intended learning outcomes
Knowledge and understanding:
In the legal business practice candidates will be able to propose and defend the professional version of the choice presented to the public service and the decision in relation to any concessions.

Assessment
Written examination: 70%
Term paper: 30%
