Objectives and competences:
The main purpose of this learning unit is to consider the scope and complexity of public procurement law, individual public procurement institutes, including legal protection.
This is considered a new field of law regulating operations between contracting authorities and the private sector and pertaining to the use of public funds by the contracting authorities. It is here where strong economic interest on the one hand and public interest for a transparent and economic use of public funds on the other intertwine. Procedures and special types of public procurement as well as legal protection of tenderers in contract award procedures shall be discussed during this course.
Learning unit shall contribute towards developing the following general and subject-specific competencies:
– knowledge of public procurement procedures and the respective legal protection;
– knowledge of the respective European and Slovenian legislation;
– ability to appropriately use the knowledge in practice;
– ability to conduct independent student and research work under the supervision of a mentor;
– familiarity with the sequence of the respective legal acts;
– ability to connect legal theory with legal practice in the field of public procurement;
– organisational skills for the organisation of active and independent work.
Intended learning outcomes:
Knowledge and understanding:
– a student understands the fundamental principles of public procurement and legal protection in public procurement procedures;
– a student is familiar with the European and Slovenian regulation in the field of public procurement;
– a student is familiar with basic terms in the field of public procurement, knows public procurement exceptions, basic definitions of technical and other elements of public procurement as well as qualification assessment criteria and selection criteria;
– a student is familiar with public procurement procedures and other special methods of procurement;
– a student is familiar with contract notice and communication requirements;
– a student is familiar with the procedure for the provision of legal protection in public procurement procedures;
– a student develops competencies for the active monitoring and management of public procurement procedures.
Learning and teaching methods:
– lectures with the active participation of students(presentation, discussion, questions, examples, problems solving);
– individual and/or group consultation (discussion, additional explanation, specific issues).
Assessment:
written (60%) and oral (40%) exam is requested.
