Content (Syllabus outline)
In the first part the course explains the social significance and the role of criminal procedural law, the relationship between substantive and procedural criminal law, the historical development of criminal procedure and basic principles of criminal procedure. In the second part the students are acquainted with the subjects of criminal procedure and the object of criminal proceedings. Students are also acquainted with the procedural acts of establishing facts in criminal proceedings, evidence, clues, inspection, and house search. The course deals with the entire procedure of criminal proceeding from pre-trial to the charge.

- Criminal Procedure Act (Official Gazette of RS, no. 63/1994 with amendments).
Objectives and competences
The course introduces students to the legal thinking and legal terminology. It represents a fundamental introductory course to the study of law.
Intended learning outcomes
Knowledge and understanding:
The student gets competence of scientific analyses of problems from the selected legal topics, competences of evaluation of different theoretical points of view, competence of critical analyses of jurisprudence and knowledge for an advanced written argumentation. The student is able to make a case-study as regards potential procedural law problems of a given case.
Learning and teaching methods
Lectures on the topics mentioned above, and pointing our relevant case-law of the Slovenian courts, ECtHR and the US Supreme Court (selected cases).
Seminar tutorial – a more detailed analysis of the above mentioned case-law, as well as EU criminal procedural law instruments; preparation for written exam (group case-studies).
Assessment
Written examination (120 minuted, three parts – 1st part: Multiple-choice questions on the current Criminal procedural Act; 2nd part: Theoretical questions; 3rd part: Case Study).
